Service Description
Ochre Sail provides managed AI systems designed to help independent businesses operate more efficiently and serve customers more effectively. Our services are hosted, monitored, and maintained by Ochre Sail on your behalf.
Services available through the Ochre Sail platform include:
- AI-powered customer service (24/7 chat, after-hours phone coverage, review response)
- Marketing automation (content creation, social media scheduling, lead follow-up)
- Appointment scheduling and calendar management
- Content creation and publishing workflows
- Business intelligence and data reporting
- Custom AI workflows tailored to your business operations
The specific services available to your account depend on your selected plan. Ochre Sail reserves the right to add, modify, or retire individual features with reasonable notice.
Accounts and Access
Clients access Ochre Sail services through the platform portal provided at the time of onboarding. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- Account credentials must be kept secure and not shared with unauthorized parties.
- One account per business unless otherwise arranged in writing with Ochre Sail.
- You must notify us promptly at sailor@ochresail.com if you suspect unauthorized access to your account.
- You are responsible for ensuring that anyone who accesses the platform through your account complies with these Terms.
Pricing and Payment
Ochre Sail services are billed on a monthly basis. Pricing is determined by your selected service tier as outlined at the time of enrollment. Pricing may change with 30 days written notice.
- Monthly billing: Services renew automatically each month unless cancelled in accordance with Section 4.
- Onboarding fees: A one-time onboarding fee may apply depending on the scope of initial setup. This fee covers configuration, testing, and launch of your AI workflows.
- No long-term contracts: All plans are month-to-month. We do not require annual commitments.
- Payment processing: Payments are processed through our secure third-party payment processor. Ochre Sail does not store your full payment card details.
Cancellation
Either party may cancel the service agreement at any time with 30 days written notice. Cancellation requests must be sent to sailor@ochresail.com.
- No cancellation penalty: There is no fee or penalty for cancelling your service.
- Data export: Upon cancellation, you will have 30 days to request an export of your business data. After that period, data will be deleted in accordance with our Privacy Policy.
- Final billing: Any amounts owed through the end of the notice period will be billed as normal. Prorated refunds are not provided for partial months.
Acceptable Use
You agree to use Ochre Sail's services only for lawful business purposes and in compliance with all applicable laws and regulations. The following uses are prohibited:
- Illegal purposes or activities that violate any applicable law or regulation.
- Sending spam, unsolicited commercial messages, or bulk communications without recipient consent.
- Harassment, abuse, or threatening behavior directed at any person.
- Making automated, AI-driven decisions with significant impact on individuals (employment, credit, housing, healthcare) without appropriate human oversight and review.
- Attempting to reverse-engineer, circumvent, or interfere with the platform's AI systems or infrastructure.
- Impersonating another person or entity in a deceptive manner.
AI Limitations
AI systems, including those powering Ochre Sail's platform, have inherent limitations. By using our services, you acknowledge and agree to the following:
- AI systems may produce outputs that are incorrect, incomplete, outdated, or otherwise unsuitable for your purposes.
- Ochre Sail does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content.
- You are responsible for reviewing AI-generated outputs before acting on them, especially in customer-facing or high-stakes contexts.
- AI should not be used as a replacement for advice from licensed professionals in medical, legal, financial, or other regulated fields.
We monitor our AI systems for quality and work continuously to improve performance, but we cannot guarantee error-free operation.
Intellectual Property
Ownership of intellectual property is as follows:
- Ochre Sail platform: Ochre Sail retains all ownership of the platform, its underlying AI systems, proprietary workflows, and related technology. No license to the platform's source code or systems is granted.
- Your business data: You retain full ownership of all business data, content, and materials you provide to the platform. Ochre Sail has a limited license to process this data solely for the purpose of delivering services.
- AI-generated outputs: Content and outputs generated by the AI on your behalf belong to you. You may use, publish, and modify AI-generated outputs as you see fit, subject to any applicable third-party AI provider terms.
Limitation of Liability
Ochre Sail's services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.
Ochre Sail is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, business interruption, or reputational harm, even if we have been advised of the possibility of such damages.
Data and Privacy
Your use of Ochre Sail's services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you agree to the collection, use, and processing of your data as described in the Privacy Policy.
Ochre Sail processes all personal data in accordance with applicable privacy laws. If you have questions about how we handle your data, please contact sailor@ochresail.com.
Modifications to Terms
Ochre Sail may update these Terms of Service from time to time. When we make material changes, we will provide at least 30 days written notice before the updated Terms take effect. Notice will be provided by email to the address on file with your account.
Your continued use of the services after the effective date of updated Terms constitutes your acceptance of the revised agreement. If you do not agree to the updated Terms, you may cancel your account in accordance with Section 4.
Governing Law
These Terms of Service and any disputes arising out of or related to them are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal proceedings shall be brought in the courts of North Carolina.
